Terms & Conditions

1. Who you are contracting with

These Terms govern your use of ARIA and related services (the "Service") provided by 3-Tech ("we", "us", "our"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you confirm you have authority to bind that organization.

2. The Service

ARIA is an autonomous AI marketing agent that generates content, runs campaigns, and reports on performance across channels. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.

3. Acceptable use

You must not, and must not allow others to:

  • use the Service unlawfully or for fraud, spam, or harassment;
  • infringe intellectual property or privacy rights of others;
  • interfere with the security or integrity of the Service (malware, probing, scraping);
  • reverse engineer, resell, or redistribute the Service or its outputs in violation of these Terms.

4. AI-generated content

You are responsible for the prompts you submit and how you use ARIA's outputs. Outputs may be inaccurate or incomplete and are not a substitute for professional advice. You must have the rights to any content you input. We may filter, restrict, or refuse outputs that violate our policies, and we may suspend accounts for repeated infringement.

Prohibited uses include illegal content, deepfakes, hate speech, malware, jailbreaking the model, or generating content that misrepresents real individuals without consent.

5. Intellectual property

3-Tech retains all right, title, and interest in the Service, including its software, documentation, and branding. You retain rights to content you submit, subject to the licence you grant us to host and process it to provide the Service.

6. Payments, billing & subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy for our refund window.

7. Service availability

We work hard to keep the Service running, but we do not guarantee uninterrupted or error-free performance. We disclaim all implied warranties to the fullest extent permitted by law.

8. Suspension & termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; we may delete your data after a reasonable export window.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid us in the prior twelve (12) months. We are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.
